ZharaTek provides AI-powered voice automation services including inbound and outbound call handling, appointment scheduling, lead qualification, and related business communication tools for the health, wellness, and fitness industries.

3. Use of Services

You agree to use our services only for lawful purposes and in accordance with these Terms. You shall not:

• Use the services for any illegal or unauthorized purpose
• Violate any applicable laws or regulations, including those related to call recording and consumer protection
• Attempt to interfere with or disrupt the integrity or performance of the services
• Misrepresent your identity or affiliation when using our AI voice services

4. Call Recording Compliance

You are solely responsible for ensuring compliance with all applicable federal, state, and local laws regarding call recording and monitoring, including obtaining any required consents from callers. ZharaTek is not liable for your failure to comply with such laws.

5. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

6. Payment and Billing

Services are billed on a monthly basis according to your selected plan. All fees are non-refundable unless otherwise stated in your service agreement. ZharaTek reserves the right to modify pricing with 30 days' written notice.

7. Intellectual Property

All content, technology, and materials provided by ZharaTek are the exclusive property of ZharaTek and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

8. Limitation of Liability

To the maximum extent permitted by law, ZharaTek shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

9. Termination

Either party may terminate the service agreement with 30 days' written notice. ZharaTek may suspend or terminate your access immediately if you violate these Terms or engage in conduct that could harm our services or other users.

10. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Harris County, Texas.
